Terms of Service

These Terms apply to offbook.games, Offbook Games Discord applications and Activities, the Offbook desktop game builds and the connection relay that supports them, and the related multiplayer game services operated by Offbook LLC, a Texas limited liability company.

These Terms of Service ("Terms") are a binding agreement between you and Offbook LLC, a Texas limited liability company doing business as Offbook Games ("Offbook," "we," "us," or "our"). They govern your access to and use of the services described above (collectively, the "Services").

1. Acceptance and eligibility

By accessing or using the Services, you agree to these Terms and ourPrivacy Policy. If you do not agree, do not use the Services.

You must be at least 13 years old, meet the minimum age required by law and by the platform you are playing on in your country, and be legally permitted to use the Services. If you are not old enough to enter into these Terms on your own, your parent or legal guardian must review and agree to them on your behalf and is responsible for your use. The Services are not directed to children under 13.

2. Discord, Steam, and other third-party services

Some Services operate through Discord. You must also comply with theDiscord Terms of Service,Community Guidelines, and applicable server rules. These Terms are solely between you and Offbook; Discord is not responsible for the Services or this agreement. If these Terms conflict with Discord's terms as to your use of Discord, Discord's terms control for that use.

The desktop build is distributed through Steam, and your use of Steam is governed by theSteam Subscriber Agreement. These Terms are solely between you and Offbook; Valve is not responsible for the Services or this agreement.

The Services may link to or depend on other third-party services. Their terms and privacy policies govern your relationship with them. Offbook is not responsible for third-party services we do not control.

3. Accounts, identity, and security

You may need a valid Discord account, a Steam account, or another supported identity to use some features. You are responsible for activity under your account and for keeping your devices and credentials secure. Do not provide us with your password, authentication token, or full payment-card number. Tell us promptly if you suspect unauthorized access or use.

You may not impersonate another person, misrepresent your authority, evade a suspension, or use credentials or access rights that are not yours. We may rely on identity and authorization information supplied by Discord, Steam, and other providers.

4. Hosting and joining desktop games

The desktop build is not a client connecting to our game servers — it is the game server. This section governs that shape specifically, and it is the part of these Terms most likely to differ from what you expect.

If you host

Your computer runs the world and stores the record of it. Other players reach you through a join link carried by our relay. You are responsible for who you give that link to, for what happens in the session you are hosting, and for the game data stored on your machine, including any personal data of other players it contains. Treat the link as a credential; you can rotate it at any time to cut off anyone holding the old one.

If you join someone else's session

You are connecting to another player's computer, not to Offbook. Offbook does not operate that world, does not moderate it, does not see its contents, and holds no copy of it. We cannot retrieve, correct, or delete anything from it, and we cannot resolve a dispute about it. Your expectations about that session — how it is run, how long it is kept, who else is invited — are a matter between you and the person hosting it. Join sessions hosted by people you trust.

The relay

We provide the relay as a connection service only. It carries traffic and cannot read it. We may impose reasonable capacity, rate, and session limits, perform maintenance, and suspend or discontinue the relay as described in § 9. We do not guarantee that any particular session, link, or host will remain reachable.

5. Multiplayer gameplay, logs, and transcripts

Offbook games are shared experiences. Your display name, avatar, character, commands, choices, and other gameplay may be visible to other participants. For games we host, gameplay events and campaign state may be stored in checkpoints and event logs so the game can run, save, resume, and be reconstructed, and may appear in transcripts where that feature is available and enabled. ThePrivacy Policy explains these records, and which of them we hold at all, in more detail.

Do not submit confidential information or personal data you do not want other participants to see. You are responsible for content you submit and for your interactions with other users.

6. Acceptable use

You may use the Services only for lawful, personal, and non-commercial entertainment unless Offbook gives you written permission otherwise. You must not:

• harass, threaten, exploit, abuse, or harm another person, or facilitate hate, violent extremism, illegal conduct, or sexual content involving minors;
• violate privacy, publicity, intellectual-property, or other rights;
• upload malware, interfere with the Services, bypass security or access controls, probe for vulnerabilities, or overload our systems or the relay;
• scrape, harvest, or collect data from the Services or other users except as expressly allowed by Offbook and applicable law;
• reverse engineer or circumvent the Services except to the limited extent a restriction is prohibited by law;
• use automation, bots, cheats, or exploits to disrupt play, manipulate access or purchases, or gain an unfair advantage;
• use the Services or their output to build a competing service or commercially exploit Offbook content without permission; or
• encourage, assist, or attempt any prohibited conduct.

You can report safety, conduct, or application issues through Offbook Support. We may investigate reports and take action we reasonably consider appropriate. Note that our ability to act on conduct inside a desktop session hosted by another player is limited to the relay — we can restrict access to our services, but we cannot moderate a world we do not operate.

7. Intellectual property and licenses

Offbook materials

The Services, game titles, software, stories, characters, artwork, audio, designs, and other materials supplied by Offbook or its licensors are protected by intellectual-property laws. Subject to these Terms, Offbook grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Services for their intended purpose. No other rights are granted.

Offbook Games™, associated names, logos, and trade dress are trademarks of Offbook LLC. A United States trademark application for Offbook Games is pending. You may not use our branding in a way that suggests endorsement or affiliation without written permission.

Your content

You retain any rights you have in original content you submit. For content that reaches our systems, you give Offbook a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process it only as reasonably necessary to operate, secure, support, and improve the Services, reconstruct games, provide transcripts, comply with law, and enforce these Terms. This license lasts as long as the content is retained for those purposes. Content that stays on a host's machine and never reaches us is not covered by this license, because we never receive it.

If you send voluntary ideas or feedback, you permit us to use them without restriction or compensation, but you are not required to provide feedback.

8. Paid offerings and refunds

Some titles or features require a purchase. The price, what it includes, and the store handling it are shown before you buy. You authorize the applicable store to charge the displayed amount, taxes, and any disclosed recurring charges. That store's terms also apply.

Purchases through Discord's store — including any recurring offering — are billed and controlled by Discord. A recurring offering renews until canceled; cancellation normally prevents the next renewal while access continues through the displayed service-period end, although refunds, reversals, fraud, or provider-required action may end access sooner. Manage and cancel these through Discord.

Purchases of the desktop build are one-time purchases transacted through Steam. What you installed is what you own: a purchased build stays playable to you without a further check, and a demo build never contains or unlocks paid content. Steam's refund rules apply to these purchases, and nothing in these Terms limits a refund right Steam or applicable law gives you.

Prices and features may change prospectively; we will provide notice when required. Except where a store's policy or applicable law provides otherwise, purchases are final. See ourRefund Policy for how to make a request. Reading, exporting, or deleting a transcript already validly recorded is not conditioned on any continuing payment.

9. Content, ratings, and fictional experiences

Offbook provides fictional, interactive entertainment. Titles may include suspense, violence, mature themes, flashing effects, or other content that is not suitable for every user. Review available descriptions, ratings, and warnings before playing. Unless a title is clearly labeled otherwise, it is not professional medical, legal, financial, or safety advice.

10. Availability and changes

The Services are in development and may change, contain errors, or be interrupted. We may add, modify, suspend, or discontinue features, titles, or the relay; impose reasonable usage or capacity limits; or perform maintenance. We do not promise that a particular campaign, title, transcript, session, or feature will remain available forever. Where applicable, we will honor paid service periods or provide a remedy required by law.

11. Suspension and termination

You may stop using the Services at any time. We may limit, suspend, or terminate access if we reasonably believe you violated these Terms or applicable law, created risk or harm, failed to pay, abused the Services, or if suspension is necessary for security or operations. When practical, we will provide notice and an opportunity to address the issue.

Sections that by their nature should survive termination will survive, including intellectual property, payment obligations, disclaimers, liability limits, dispute terms, and provisions concerning retained data. Data handling after termination is governed by the Privacy Policy.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." OFFBOOK AND ITS LICENSORS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

OFFBOOK IS NOT RESPONSIBLE FOR THE CONDUCT OF A PLAYER WHO HOSTS A DESKTOP SESSION, FOR THE SECURITY OR AVAILABILITY OF THAT PLAYER'S COMPUTER, OR FOR WHAT THEY DO WITH THE GAME DATA STORED ON IT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFBOOK LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THOSE PARTIES FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OFFBOOK FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Offbook LLC and its members, managers, employees, contractors, and licensors from third-party claims, damages, losses, and reasonable costs arising from your content, your unlawful or unauthorized use of the Services, sessions you host, or your material violation of these Terms or another person's rights. This section does not require you to indemnify a party for its own unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except to the extent the law where you live requires otherwise. Before filing a formal claim, you and Offbook agree to try in good faith for 30 days to resolve the dispute by written notice to the other party. Send your notice tosupport@offbook.games with the subject "Legal Notice."

If a dispute is not resolved informally, it may be brought in a state or federal court in Texas that has jurisdiction and proper venue, unless applicable consumer law gives you the right to proceed elsewhere. Nothing in this section prevents either party from seeking urgent injunctive relief or using an eligible small-claims court.

16. Changes to these Terms

We may update these Terms as the Services or the law change. We will post the revised Terms here and update the date above. If a change is material, we will provide additional notice when required. Changes apply prospectively. Your continued use after the effective date of revised Terms means you accept them; if you do not agree, you must stop using the Services.

17. General terms

These Terms, together with the Privacy Policy,Refund Policy, and any purchase terms shown to you, are the entire agreement between you and Offbook concerning the Services. If a provision is unenforceable, it will be modified only as much as needed and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer. Headings are for convenience only.
